This is the constitution put in place by the Brazilian military government three years after they took over in a coup. It was put into place after the old constitution along with the Institutional Acts that were considered above it were no successful in keeping the opposition from beginning to take power. In order to prevent their regime from being overturned, they created a new constitution that greatly restricted the civil and political rights. This made the government effectively a dictatorship.
This document is very significant in the Brazilian popular music of the 1970’s as it was the point where the new military government became fully authoritarian. It paved the way for future amendments and institutional acts, such as Institutional Act Five, that would allow for the government to heavily censor all media. It was only when this constitution was overturned and its successor forbid censorship that the government lost its control over the media. This document, along with Institutional Act Five, is essential in the context of why the 1970’s in Brazil was such a notable period.
“CAPÍTULO I – Disposições Preliminares
Art.1º – O Brasil é uma República Federativa, constituída sob o regime representativo, pela união indissolúvel dos Estados, do Distrito Federal e dos Territórios.
§ 1º – Todo poder emana do povo e em seu nome é exercido.
§ 2º – São símbolos nacionais a bandeira e o hino vigorantes na data da promulgação desta Constituição e outros estabelecidos em lei.
§ 3º – Os Estados, o Distrito Federal e os Municípios poderão ter símbolos próprios.
Art.2º – O Distrito Federal é a Capital da União.
